These Terms of Service ("Terms") govern your access to and use of the website lmcreamery.com (the "Site"), operated by Little Mountain Creamery ("we," "us," or "our"), located at 7872 Crile Road, Painesville, Ohio 44077. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
You may use the Site for lawful, personal, non-commercial purposes. You agree not to: (a) use the Site in a way that violates any applicable law or regulation; (b) attempt to gain unauthorized access to any portion of the Site, including administrative areas; (c) interfere with or disrupt the operation of the Site; (d) submit false, misleading, or abusive content through our forms; or (e) use automated means to scrape or harvest content or data from the Site.
Our flavors rotate frequently and availability changes daily. Menu items, descriptions, and prices displayed on the Site are provided for general information, are subject to change without notice, and may differ from what is available in store at any given time. In the event of a discrepancy between the Site and in-store pricing, in-store pricing controls.
Important: Our products are prepared in a kitchen that handles common allergens, including milk, eggs, tree nuts, peanuts, wheat, and soy. Although we take care in preparation, we cannot guarantee that any product is free of any allergen due to the risk of cross-contact. If you have a food allergy or dietary restriction, please speak with a member of our staff before ordering. Statements on the Site such as "dairy-free," "gluten-free," or "vegan" describe recipe ingredients and are not a guarantee against cross-contact.
Online orders are placed and paid for through Clover, a third-party platform operated by Fiserv, Inc. Your use of Clover is subject to Clover's own terms and privacy policy. Orders are for pickup at our location. If there is a problem with an order, please contact us directly and we will work with you to make it right.
Submitting a catering request through the Site (including the embedded JotForm form) is a request only and does not by itself create a binding reservation. Catering bookings are confirmed only when we communicate confirmation to you, and are subject to the pricing, deposit, notice, and cancellation terms we provide at the time of booking. Custom cakes, pies, and similar made-to-order items require advance notice.
Gift cards are redeemable for merchandise at our location and cannot be redeemed for cash except where required by law. We are not responsible for lost or stolen gift cards. Additional terms provided at the time of purchase apply.
The Site and its contents — including our name, logo, photographs, text, and design — are owned by Little Mountain Creamery or used with permission, and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission, except for personal, non-commercial viewing.
By submitting information through our forms (such as inquiries, feedback, or employment interest), you represent that the information is accurate and that you have the right to provide it. You grant us permission to use your submission for the purpose of responding to and processing your request, consistent with our Privacy Policy.
The Site links to and embeds third-party websites and services, including Clover, JotForm, Google Maps, and social media platforms. We do not control and are not responsible for the content, policies, or practices of these third parties. Your use of them is at your own risk and subject to their respective terms.
The Site is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete, accurate, or current.
To the fullest extent permitted by law, Little Mountain Creamery and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Little Mountain Creamery and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Lake County, Ohio, and you consent to the jurisdiction of those courts.
We may revise these Terms from time to time. When we do, we will update the effective date at the top of this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding use of the Site.
